1. Scope and provider

These Terms of Use apply to the use of the mobile application “MomentMal” (the “App”). The App is provided by:

2. Description of the service

MomentMal is an app for creating and managing personal bucket lists. You can create lists and items, add photos and places, capture memories and share lists with other people. The App is currently free of charge and contains no advertising. We reserve the right to further develop or change the range of features, or to discontinue individual features.

3. Account and registration

An account is required to use the App. You must provide truthful information when registering and are responsible for keeping your login details confidential. The App may be used by persons aged 14 and over; minors require the consent of a parent or legal guardian.

4. Your content

Content you create in the App (lists, items, texts, photos, places) remains your property. You merely grant us the simple (non-exclusive), revocable right to store and process this content and to display it to the people you invite, to the extent necessary to operate the App. We do not use your content for advertising and do not pass it on to third parties (see Privacy Policy).

You are responsible for ensuring that your content does not infringe the rights of third parties (in particular copyrights and personality rights, e.g. in photos of other people).

5. Prohibited content and use

It is prohibited to create or share content via the App that:

• is unlawful, insulting, threatening, discriminatory or glorifies violence,
• contains pornographic depictions or material harmful to minors,
• infringes the rights of third parties (e.g. copyrights, trademark rights, personality rights),
• contains malware, spam or misleading information.

It is likewise prohibited to attempt to manipulate or overload the App or its servers, or to gain unauthorized access to other people's accounts or data.

6. Reporting and moderation

Content in shared lists can be viewed by the members of that list. If you come across prohibited content, you can report it in the App or let us know at office@momentmal.net. We review reports promptly and may remove prohibited content as well as suspend or delete accounts that repeatedly or seriously violate these Terms.

7. Shared lists

When you share a list, invited people can see and edit the contents of that list. You decide yourself whom you invite and can remove members at any time. As the owner of a list, you share responsibility for its content.

8. Availability

We strive to keep the App available with as few interruptions as possible, but cannot guarantee this. Maintenance work, updates or technical faults may lead to temporary restrictions. There is no entitlement to constant availability when using the App free of charge.

9. Liability

We are liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In cases of slight negligence, we are liable only for breaches of essential contractual obligations, and limited in amount to the foreseeable damage typical for this type of contract. Liability under mandatory statutory provisions (in particular the Austrian Product Liability Act) remains unaffected.

We recommend that you also back up important content yourself.

10. Termination

You can delete your account in the App at any time (Profile → Delete account); this permanently removes all associated data. We may terminate the contractual relationship with reasonable notice, or suspend or delete your account in the event of serious violations of these Terms.

11. Changes to these Terms

We may amend these Terms of Use when features or legal requirements change. We will inform you of material changes in the App. You will always find the current version on this page.

12. Notes for Apple users

If you obtained the App via the Apple App Store, the following also applies: Apple is not a party to these Terms of Use and is not responsible for the App, its content or support. Apple and its subsidiaries are third-party beneficiaries of these Terms of Use and may enforce them against you. You confirm that you are not located in a country that is subject to a U.S. embargo and that you are not listed on any U.S. sanctions list.

13. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, the mandatory consumer protection provisions of your country of residence remain unaffected. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
